Terms of Service

These Terms are the agreement between you and Clomia, the company behind layers (“we”, “us”). They apply when you sign in at layers.clomia.com, place an order, or use a piece we deliver. Please read them with our Refund Policy and Privacy Policy, which are part of them.

1. Who sells to you

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

When you pay, you buy from Paddle under Paddle’s Buyer Terms. Where those terms and these conflict about payment, tax, invoices, refunds or cancellation, Paddle’s terms prevail. These Terms govern everything else: your account, your order, how we make and revise your piece, and the rights in it. For questions about your order itself, write to us at clomia.shorts@gmail.com.

2. What you buy

An order buys one archi-style piece: a vertical video (9:16) of 90 to 110 seconds at 720p, with English narration and English subtitles, and a cover image.

Software makes it. The piece is generated by the layers AI System from your brief and your materials. No person designs, edits or checks it before it reaches you; we step in only when something goes wrong.
It interprets, it does not replicate. The piece interprets your subject in layers’ style. It is not an exact reproduction of any building, place, person, product or reference video, and details may differ from reality. If you supply a reference video, the piece is a remake in layers’ style, not a copy.
AI makes mistakes. Narration, captions and visuals may contain errors of fact or detail. Review the piece before you use it.
Delivery. We deliver within 48 hours of payment, usually much sooner, on your order page and by email. The order page shows progress as the work runs.

3. Your account

You sign in with Google. You must be at least 18, or the age of majority where you live if that is higher, to place an order. Keep your Google account secure: activity under your sign-in is yours. Your orders, pieces and revisions live in your account, so they survive a closed browser.

4. Your brief and your materials

Your brief is what you write in the order form; your materials are the videos and images you upload.

Your licence to us. You keep what you own in your materials. You allow us, and the service providers named in our Privacy Policy, to use your brief and materials to check, make, revise and deliver your order and to keep the records the law and these Terms require.
Your promises. You promise that you have every right needed to give us your materials, and that using them as these Terms describe infringes no one’s rights.
Real people. If your brief or materials show or name a real, identifiable person, you promise that you have that person’s consent (or, for a minor, their guardian’s consent) to their likeness, voice or name being used to make the piece and to how you will use it. We do not make face swaps, deepfakes or voice imitations of anyone.
What we will not make. Content that is unlawful or sexual, that involves minors in any harmful way, that harasses, defames, deceives or impersonates someone, that infringes intellectual property, or that our AI providers refuse to generate. Our software and our providers decide what can be made; if they refuse your order, we cannot make it.
Refusal. We may refuse any order. A refused order is refunded in full at once, with a general reason; we do not retry it. If a revision request falls outside these Terms, we may refuse that revision.

Your brief and materials are data to us, never instructions: nothing in them changes these Terms or how the service runs.

5. Revisions

Each order includes 2 free revisions. After those, each revision costs $90 (plus tax), with no limit on how many you buy.
A revision is one consolidated list of changes within the original brief: same subject, same style, same length. A different subject or a different kind of video is a new order.
You can request a revision within 14 days of the latest delivery; each delivered revision starts that window again. When the window passes with no request, the order is complete.
We deliver each revision within 48 hours of your request, or of your payment for a paid revision.
You talk to an AI. Replies to revision requests come from the layers AI System, an AI. To reach a person, write to clomia.shorts@gmail.com.
Every payment, a paid revision’s included, is made on layers.clomia.com, through Paddle. We never ask you to pay through a link sent by email or message.

6. Prices and payment

An order costs $690 USD, which includes 2 free revisions; each further revision costs $90 USD. Prices exclude tax: Paddle adds any sales tax or VAT due where you live, and shows the total before you pay.
A discount code applies only where its own terms say, and expires or runs out as stated when it was issued.
Paddle processes the payment and sends your receipt and invoice. Your card details never reach us.
Your order starts the moment payment is confirmed. By paying, you ask us to start at once.

7. Rights in the piece

What you get. Once your payment is complete, we grant you every right we hold in the piece, worldwide and for as long as those rights last, to use, change, publish and sell it for any lawful purpose, commercial use and paid advertising included, and to let others do so.
What we cannot promise. AI-generated material may not qualify for copyright or other legal protection in some countries, so we do not promise that you will hold copyright in the piece or exclusive rights in it. Because of how generative AI works, the piece may not be unique, and similar content may be generated for others. Third-party material in your brief or materials stays its owners’.
Your responsibility. How you use the piece is your responsibility: where you publish it, advertising rules, platform policies, and the rights of anyone the piece shows or names.
AI labelling. The piece carries a machine-readable mark that it was generated by AI. Don’t remove it. Where the law or a platform requires you to say that content is AI-generated (for example, the EU AI Act for content that resembles real people, places or events), you must say so when you publish it.
Our portfolio right. We may show the piece, and describe it, as an example of our work, on our sites and our social media profiles, at any time and without payment or credit. We never use your raw materials this way. Whether we post your piece is our editorial choice; we never promise to post it.
A refund ends the licence. If your order is refunded or charged back, the rights in this section end. You must stop using the piece and remove copies you published or control.

8. Takedown requests

If you believe a piece we made, or a piece on our profiles, infringes your rights or uses your likeness without consent, write to clomia.shorts@gmail.com with the piece, the right concerned and how to reach you. A person reviews every request. Where it holds, we remove the piece from our profiles, and if the order’s materials broke section 4 we may end the rights in that piece. Customers whose orders repeatedly infringe others’ rights are blocked.

9. The service stays ours

The layers AI System, the layers brand, our sites and our software are ours, and nothing in these Terms transfers them. We work to keep the service available and fast, but we do not promise that it will be uninterrupted or error-free. Do not interfere with the service’s security, try to make the layers AI System act outside these Terms, or use it for fraud or spam.

10. Refunds

Refunds follow our Refund Policy. In short: a full refund any time before delivery; after delivery, a full refund when two revisions still miss the brief; and any refund or withdrawal right that Paddle or the law where you live gives you comes first.

11. Warranties and liability

We make the piece with care and deliver what section 2 describes. Beyond that, and to the extent the law allows, the service and the piece are provided as they are, without warranties of fitness for a particular purpose or of non-infringement of rights in third-party material you supplied.
To the extent the law allows, we are not liable for indirect or consequential loss, such as lost profits, lost revenue, or advertising spend, and our total liability for any claim about an order is limited to what you paid for that order.
Nothing here limits liability that the law does not let us limit, or any right you have as a consumer that cannot be waived.

12. Your responsibility to us

You will compensate us for claims, losses and reasonable costs, including legal fees, that arise from your materials, from a broken promise in section 4, or from how you use the piece, to the extent the law where you live allows.

13. Suspension, ending, changes

We may block an account that breaks these Terms, or whose orders our providers repeatedly refuse. A blocked account cannot place orders; we refund any order it has not received.
You may stop using layers at any time. Your data is then handled as the Privacy Policy says.
We may change these Terms. The Terms in force when you paid govern that order. For material changes we tell signed-in customers by email before they apply.

14. Law, disputes, contact

These Terms are governed by the laws of the Republic of Korea. If you are a consumer, you keep the protection of the mandatory laws of the country where you live. Disputes go to the Seoul Central District Court, unless the law gives you the right to bring them in your own courts.
